J. Derek James
Derek James has been a lawyer for over 37 years. Derek offers clients a wide range of experience for insurance law matters, including complex coverage issues, technical legal issues, statutory interpretation disputes, underwriting related issues, conflict of laws disputes, and interjurisdictional issues.
He also provides a wide range of experience defending personal injury claims, including claims involving brain injuries, catastrophic injuries, and multiple party, multi-accident claims. He is equally qualified handling trials involving multiple accident claims, as he is appeals of complex coverage and interjurisdictional issues.
Derek has extensive courtroom experience including appeals, judge alone trials, and jury trials. He has represented clients in numerous alternate dispute resolutions, including mediations and arbitrations. He has experience in administrative law matters, including hearings and appeals from tribunal decisions.
Derek is one of the select few lawyers in B.C. who combines extensive experience defending claims with detailed knowledge of coverage issues, including interjurisdictional issues.
CONTRIBUTIONS TO CONTINUING LEGAL EDUCATION
For many years Derek has been selected to be the author of Chapter One (“Preliminary Matters”), British Columbia Motor Vehicle Accident Claims Practice Manual. He is a frequent contributor to Continuing Education courses. He is also well-known for providing mentoring support to fellow members of the bar.
